Terms of use

These terms cover how merchants and their team members use Amplify. By creating an account, you accept them. We wrote them to be easy to read: if something isn't clear, write to us at support@amplify.tn.

Who we are

Amplify is run by [raison sociale et forme juridique], registered with the National Business Register under number [identifiant unique RNE], with its registered office at [adresse du siège]. In these terms, “we” means Amplify, and “you” means the merchant or team member using the service.

The service

Amplify lets you build an online store, take cash on delivery orders, confirm them, hand them to a delivery company and follow your results. An AI assistant can help you build and change your store.

We keep improving the service: features may be added, changed or removed. When a change removes a feature you use, we tell you in advance.

Your account

  • You must be at least 18 and able to enter into a contract.
  • Your account details must be accurate. You confirm your email address before you sign in.
  • You keep your password secret and tell us straight away if you think someone else is using it.
  • You are responsible for what is done from your account and from the accounts of the team members you invite, within the permissions you give them.
  • Every store always has at least one owner, who answers to us for the store.

Prices and credits

Using the platform is free: the store, orders, delivery and analytics. The AI features (the assistant and writing help) use credits.

  • Every new store gets 100 free credits.
  • You can buy credit packs: 100 credits for 25.000 DT, 300 credits for 65.000 DT, 1000 credits for 190.000 DT. Prices are in Tunisian dinars.
  • Our team contacts you to arrange payment (bank transfer, D17 or cash). Credits are added to your store as soon as the payment arrives.
  • Credits don't expire. They belong to the store they were bought for and can't be exchanged for money.
  • What an assistant reply costs depends on what it changes; it is shown in the store's history. A reply that fails or that we cancel costs nothing.
  • If we stop the AI features, or close your account through no fault of yours, we refund the credits you bought and haven't used.

If we ever introduce a subscription or platform fees, we will tell you at least 30 days in advance, and nothing is charged without your agreement.

Your store and your sales

You are the seller. The sale is between you and your customers: Amplify is not the seller, a payment intermediary or a carrier.

  • You are responsible for your products, their descriptions and prices, delivery, returns and customer service.
  • You follow the laws that apply to your business, including Law No. 2000-83 of 9 August 2000 on electronic exchanges and commerce, and consumer protection rules.
  • Your store shows the information the law requires from an online seller (who you are, how to reach you, your prices and terms of sale).
  • Your customers' data is yours. You are responsible for it, and we process it on your behalf (see our privacy policy).

What isn't allowed

You may not use Amplify to:

  • sell illegal, counterfeit or dangerous products or services, or regulated ones without authorisation (weapons, drugs, medicines, etc.);
  • publish content that is misleading, hateful, violent or pornographic, or that infringes others' rights (trademarks, copyright, likeness, privacy);
  • send unsolicited messages or collect data without a legal basis;
  • try to reach data or stores that aren't yours, disrupt the service, get around its limits or use it in an automated way without our agreement;
  • resell or copy the service, its themes or its code.

If a store breaks these rules, we may remove content, suspend the store or close the account depending on how serious it is, and we explain why unless the law prevents us.

The assistant and AI

  • The assistant suggests content and changes. It can make mistakes: review what it prepares before you publish it. What is published on your store remains your responsibility.
  • Changes are made in a draft. Anything that goes live or spends money waits for your approval.
  • To answer, the assistant sends your messages and the relevant content of your store to our AI provider. We don't use your content to train models, and our provider has committed to the same by contract.
  • To keep the service safe and good, our team may review flagged conversations and the assistant's replies.

Third-party services

You can connect your store to other companies' services: delivery companies, Meta (Pixel and Conversions API), a custom domain. Their own terms apply. We aren't responsible for those services, their prices or their outages.

The credentials you give us for these services are encrypted and used only for the actions you ask for.

Your content and ours

Your content (products, text, images, brands) stays yours. You allow us to host, copy and display it as far as needed to run your store and the service, for as long as you use it.

The platform, its themes, its code and the Amplify brand are ours. You can use the themes for your store while your account is active.

You can ask us at any time for a copy of your data (products, orders, customers) in a common format.

Availability

We do our best to keep the service available and safe, and back up data every day. It may still be interrupted for maintenance or because of an incident. We don't guarantee that it will run without interruption or errors.

Liability

As far as the law allows, we aren't liable for indirect losses (lost revenue, customers or data) from using the service. Our total liability is limited to what you paid us in the 12 months before the event.

These limits don't apply to gross negligence or wilful misconduct on our part, or where the law forbids them.

Closing your account

You can close your account or your store at any time by writing to support@amplify.tn. Before it's closed, you can ask for a copy of your data.

We may suspend or close an account that breaks these terms, with notice except in urgent cases (fraud, security, a request from an authority).

After closing, the store's data is deleted within 30 days and leaves our backups as they rotate, except what the law requires us to keep (such as records of credit purchases).

Changes to these terms

We may change these terms. For an important change, we tell you by email or in the app at least 30 days before it applies. If you don't agree, you can close your account before then.

Governing law and disputes

These terms are governed by Tunisian law. If we disagree, write to us first and we will look for an amicable solution. Failing that, the courts of Tunis have jurisdiction.
